Purpose:

To settle the outstanding claim with contractor Alun Griffiths Ltd for the North Fringe to Hengrove Package project. Budget to cover this decision was approved at Cabinet 3 March 2022, item 15 refers.

Decision:

To approve settlement payments up to a maximum of £390k, for Bristol City Council’s (BCC) share, in settling the outstanding Alun Griffiths Ltd claim for the North Fringe Hengrove Package project. South Gloucestershire Council (SGC) are the lead authority for the project and have led all contract negotiations.

Alternative options considered:

Option 1 - Discussions regarding how to settle the claim with Alun Griffiths Ltd have been ongoing since spring 2021. A formal Project Board, comprising officers from BCC, SGC and others, has met regularly to consider the various options. SGC has received formal advice from their appointed NEC Project Manager and barrister. The decision making protocol for Project Boards is covered by a Joint Promotion Agreement signed by partner Local Authorities. Cllr Don Alexander, Cabinet Member for Transport, was consulted on 6 March 2022.
