This variation application seeks to remove and replace conditions in the Operating Schedule as follows:

 

Condition 7 in Annex 3 to be replaced with the following:

There shall be a minimum of 2 door supervisors, who have been accredited by the Security Industry Authority or any accreditation scheme recognised by the Licensing Authority, on duty from 21:00 hours on every Friday and Saturday night and on Sundays preceding Bank Holiday Monday who shall remain on duty until the premises closes. A minimum of 2 door supervisors, who have been accredited by the Security Industry Authority or any accreditation scheme recognised by the Licensing Authority shall be on duty from opening until close of the business during Harbourfest. At least 14 days prior to any large scale public event in Bristol city centre, THE DPS shall undertake a written risk assessment in relation to the requirement for door supervisors and shall employ door supervisors in the numbers and for the times identified in that risk assessment.

 

Condition 6 in Annex 3 to be amended to:

At any time that door supervisors, who have been accredited by the Security Industry Authority or any accreditation scheme recognised by the Licensing Authority, are employed at the premises, they shall be used to vet customers and maintain public order. The vetting process must include implementation of the premises' proof of age policy. All door supervisors must ensure that identification bearing the customers photograph, date of birth and integral holographic mark or security measure is produced before allowing entry and where it is not, entry shall be refused. Suitable means of identification would include PASS approved proof of age card, photo-card driving licences and passports.

The Committee considered the Application after hearing the representations made and decided:-

 

That the application be granted in part and rejected in part and subject to conditions in the operating schedule and two additional conditions (as set out below) which the Committee agreed were appropriate to promote the licensing objectives. The element of the application rejected being 00:00 hours till 01:00 hours for all licensable activities Friday to Saturday except Late Night Refreshment which was granted until 00:30 hours.

 

1.  The disposal of bottles shall not take place between the hours of 22:00 hours and 07:30 hours.

2. A contact telephone number of the premises Manager or other responsible person shall be available at all times when the premises is open.

 

 

Summary of Reasons:

 

1. The Committee first noted that this was a new grant premises licence application for a premises that was already licenced in the Harbourside area of the City Centre;

2. The Committee considered the Cumulative Impact Policy for the City Centre and found that it did not bite as during the week the premises would not be operating during the hours considered to be the most challenging to uphold the licensing objectives;

3. The Committee gave weight to the Police representation but noted that the Police had subsequently met with the applicant and reached a position of compromise for the hours of operation given the premises was already licenced until 2am and that the premises style of operation would not require the three conditions the Police had requested in their representation to be imposed. The applicant therefore agreed to terminate licensable activities at 00:00 hours Monday to Sunday as a concession given the Police objections and the premises being within a Cumulative Impact Area. The Committee considered the Application after hearing the representations made at the hearing and in written representations and decided:-

 

That the application be granted as applied for and subject to three additional conditions imposed by the Committee as follows:-

 

1. The Premises Licence Holder shall ensure the telephone number of a Manager or other responsible person is available at all the times the premises is open.

2. The Premises Licence Holder shall ensure that regular meetings (ie. at least quarterly) are offered to local residents to discuss any concerns relating to the premises.

3. There shall be no sale of alcohol in the outside bar after 21:30 hours.

 

 

 

Summary of Reasons:

 

1. The Committee was very sympathetic to the concerns expressed by local residents but many of the concerns fell outside the ambit of this particular application due to deregulation brought about by the Live Music Act;

2. The Committee imposed three conditions to mitigate concerns of residents regarding noise pollution and promote the licensing objectives;

3. It was noted that there was no representations from any of the Responsible Authorities;

4. The premises was well run with no complaints regarding noise and the Relevant Persons in attendance was assured that this would continue should this application be granted.
