Decision:
The Committee considered the Application after hearing the representations made. They had regard to the Licensing objectives under Licensing Act 2003, the Councils Licensing Policy, the Secretary of States guidance issued under Section 182 of the Licensing Act 2003.
The committee only imposed conditions which it regarded as appropriate and proportionate to the promotion of the Licensing Objectives.
The Committee determined to grant in part and reject in part (the part rejected being those hours that were inconsistent with the application and what was advertised – that being live music shall cease at 22:00 hours) and subject to conditions agreed with Responsible Authorities to include an amendment to the Police’s Condition No 2 to read ‘Intoxication liqor will only be sold and supplied to customers who purchase a meal as an ancillary to that meal’

Summary of the reasons:
The Committee had due regard to representations made acknowledging the following:-
1. The hours of operation were not late night and therefore the CIA was not triggered; 2. The application was not an alcohol led premises; 3. The premises was comprehensively conditioned; 4. Guidance under S182 of the Licensing Act 2003 acknowledges that the most sensitive period for people being disturbed was between 23:00 and 08:00 hours and this application was therefore not operating within this sensitive period.
