08/02/2023 - Temple Meads Northern Entrance and Southern Gateway – RIBA Stages 2 and 3 ref: 1607    Recommendations Approved

In April 2022 £94.7m of external Brownfield Investment Land (BIL) grant funding was awarded for projects in the first phase of the Temple Quarter regeneration programme. The business case and funding bid was submitted by WECA to Homes England, on behalf of Bristol City Council and Network Rail, and the grant will be administered by Homes England. In relation to this grant funding, in October 2022 Cabinet authorised the Executive Director of Growth and Regeneration to 'agree the terms of offer letters with WECA and thereafter draw down funding to prepare Delivery Plans for the relevant Infrastructure Items for which the Council is to be responsible (including procuring and awarding contracts in excess of £0.5m)'.
The Northern Entrance and Southern Gateway projects are 'Infrastructure Items' included within the grant funding bid, and work is required to develop designs for these projects up to RIBA Stage 3; this will form a key input for the Delivery Plan for these projects. This Officer Executive Decision enables the Council to enter into contract with the Strategic Partner for design work relating to RIBA Stages 2 and 3 for these projects. The TQ Directors Board, at its meetings on 9 and 23 November 2022, and the parties in subsequent discussion, have, in order to maintain progress with these two projects, (and albeit in advance of the formal Offer Letter from WECA) approved these proposals and confirmed the principle that the funding for the contract will be met from the BIL. Commissioning these services does not commit the Council to assuming responsibility for implementation of either project.
The contract will deliver the outputs set out in the Royal Institute of British Architects (RIBA) Plan of Work for Stages 2 and 3. Stage 2 focuses on developing design options for the projects and testing feasibility, and Stage 3 focuses on progressing designs for a selected preferred option, spatial coordination of design disciplines, and developing documentation to support a planning application and/or any other consents required at this stage.

1.      The realignment of Capital budgets in 2022/23 following the release of £3.3m council capital contingency and return for future capital spending pressures (see Appendix A1 section 6.1.4.).

2.      The recommendation to utilise the Council Tax Reduction additional support scheme £0.885m in full in 2023/24 to assist households in receipt of Council Tax Reduction support (see Appendix A2).

That Cabinet notes:

3.      The General Fund risk adjusted forecast overspend of £11.3m, noting the position will continue to be closely monitored and mitigations explored; however, it is likely that a further Supplementary Estimate may be required prior to the end of the financial year and should this be required appropriate approvals will need to be sought from Cabinet / Council.

4.      The forecast overspend of £8.0m within the HRA (with actual end of year position being funded by a transfer to or from the HRA general reserve).

5.      The forecast in-year deficit of £18.5m accumulating to a total £43.5m carried forward deficit in the DSG for 2023/24, and that the Council and the Schools Forum are developing a mitigation plan which will seek to address the High Needs overspend.

6.      The forecast £15.2m underspend (including corporate contingencies and funds) within the General Fund against the latest approved Capital Programme’s Budget.

7.      The submission of a bid for £5.6m funding from the Combined Authority for the development of the Western Harbour Masterplan and Infrastructure Delivery Plan project. If the bid is successful, notification of award will come back to Cabinet under separate report as a key decision.

02/02/2023 - Extension to Asbestos Surveying contract, ref: 1590    Recommendations Approved

The Undertaking of Refurbishment and Demolition plus targeted and Full Asbestos Management Surveys contract was due to end at the end of February 2023. However, the contractor is performing to a high standard and BCC are receiving a good service so we are extending the contract for the full 24 month option.
As the contract is going well and the option is available, this is the most suitable course of action for the service and avoids needing to go through another competitive tender process which takes time and would also have a considerable cost to BCC.

Decision:

Following a direction from the Secretary of State for Levelling Up, Housing and Communities received on 19th November 2022, under section 3 of the Housing Act 2004, the enforcement of Damp and Mould hazards was reviewed.
The decision details the approach that the Private Housing Service will take in relation to damp and mould issues during the Winter of 2022/23. The Council currently exercises its discretion to use its power under the Housing Act 2004 to take action on hazards rated Band D under the Housing Health and Safety Rating System (HHSRS) as well as those in Bands A-C where the Council has a duty to take action (Private Housing Enforcement Policy 2016 (revised 2017)).
There are exceptional circumstances in place this winter which justify, exercising our powers to take appropriate action on Category 2 Band E Damp and Mould hazards. Where Damp and Mould issues are identified, if, after issuing an informal schedule of works, there is no reasonable progress by the responsible person to carry out the works within a reasonable period, formal enforcement action can be taken straight away.
