The Committee considered the Application after hearing the representations made and decided:-
Decision: That the application be rejected.
Reasons:
1. The rebuttable presumption to refuse an application in the City Centre CIA was triggered as the applicant had not been able to demonstrate that the premises could be treated as an exception to the policy. The applicant was given the opportunity but was unable to address any practical management, staffing, security or other arrangements that would be put in place to mitigate the concerns raised;
2. The Committee gave great weight to the representation from the Police that the area was already at saturation point and there was nothing in the application to distinguish the premises from just another drinking establishment or to identify it as being more family friendly;
3. The Committee acknowledged the applicant’s offer to reduce the terminal hour for sale of alcohol from 23:00 to 19:00 hours but this concession was not sufficient to rebut the presumption to refuse;
4. The applicant was advised of his appeal rights and that he could submit a further, more detailed, application.
