Decision to establish the Adoption West Regional Adoption Agency (“Adoption West”)

Purpose:

Adoption West will be a regional adoption agency for 6 member Local Authorities and will be run by a Board of Council Directors. The relevant Local Authorities are Bath
and
b) Have a set of principles on which the future charging mechanisms would be based
The Members Agreement includes an acknowledgement that a more complete Business Case will be considered by the Board of Adoption West on or before 1st July 2019.

Decision:

In line with Authority delegated by Cabinet on 3rd October 2017, The Strategic Director People and Section 151 Officer in consultation with the cabinet member for Children and Young People:
1. Approve the business case for establishing Adoption West noting that the documents provide that a more detailed Business Case will be prepared and considered by the Board of Adoption West for approval by the members of Adoption West on or before 1st July 2019, and if not approved by that date shall be escalated to an extraordinary meeting of the Joint Committee, of which the Strategic Director People is a member, for approval.
2. Approve the implementation of Adoption West on the terms of the documents prepared.
3. Approve the terms of and authorise the sealing of the documents required to be entered into in respect of Adoption West, including a Commissioning Agreement, Interauthority Agreement, Members’ Agreement, Articles of Association, Network Access Agreement and Lease of part of B Bond.
4. It is noted that the Strategic Director People (DCS), in consultation with the Head of Legal Services, shall:
a. agree any changes to the Schedules of the Commissioning Agreement and to agree any further matters which are required pursuant to the terms of the Commissioning Agreement to be finalised as between the Parties following commencement of the services pursuant to the Commissioning Agreement; and
b. agree the terms of, approve and to sign or authorise the execution as a Deed (as appropriate) on behalf of the Council of any further ancillary documents that may be required in respect of or following commencement of operations of Adoption West.
