The premises were located in the City Centre Cumulative Impact Area.

 

Relevant representations had been received from the following parties, all of whom had been notified of this hearing and their rights:

The Committee considered the Application after hearing the representations made and decided:-

 

That the application be granted in part and rejected in part and subject to conditions in the operating schedule and two additional conditions (as set out below) which the Committee agreed were appropriate to promote the licensing objectives. The element of the application rejected being 00:00 hours till 01:00 hours for all licensable activities Friday to Saturday except Late Night Refreshment which was granted until 00:30 hours.

 

1.  The disposal of bottles shall not take place between the hours of 22:00 hours and 07:30 hours.

2. A contact telephone number of the premises Manager or other responsible person shall be available at all times when the premises is open.

 

 

Summary of Reasons:

 

1. The Committee first noted that this was a new grant premises licence application for a premises that was already licenced in the Harbourside area of the City Centre;

2. The Committee considered the Cumulative Impact Policy for the City Centre and found that it did not bite as during the week the premises would not be operating during the hours considered to be the most challenging to uphold the licensing objectives;

3. The Committee gave weight to the Police representation but noted that the Police had subsequently met with the applicant and reached a position of compromise for the hours of operation given the premises was already licenced until 2am and that the premises style of operation would not require the three conditions the Police had requested in their representation to be imposed. The applicant therefore agreed to terminate licensable activities at 00:00 hours Monday to Sunday as a concession given the Police objections and the premises being within a Cumulative Impact Area. The Committee welcomed this concession;

4. The Committee had regard to the concerns of the Relevant Person in attendance and the written representations but believed the premises was sufficiently conditioned to mitigate the concerns raised;

6. Two further conditions were imposed at the hearing in order to further promote the licensing objectives.
