27/04/2020 - Purchase 6,000 body bags for Flax Bourton Mortuary during the Covid 19 pandemic ref: 869    Recommendations Approved

Body bags are used by the Flax Bourton Public and Forensic mortuary in usual operation in certain circumstances. During the Covid 19 pandemic, the mortuary deceased resting place capacity was increased to accommodate the anticipated additional deceased. Deceased people at the mortuary would be resting in a different environment where the use of body bags would be appropriate. Body bags were in short supply and so a substantial stock was purchased. If they are not needed, they will be stored and used over subsequent years.

This decision is an extension to a waiver already issued, which expired on 31st December 2019.
The Whitchurch Lane site is wholly owned by BCC. It is shared with Bristol City Council (BCC) tenant, Matthew Clark Bibendum Ltd (MCBL) and BCC’s The Bottle Yard Studios (TBYS). As part of the lease terms negotiated between BCC and MCWL in 2014, MCWL retained the right to provide the manned guarding for the whole site (two guards, 24/7, 365 days/year) with costs shared equally between TBYS

29/04/2020 - Tenants' Energy Advice Service ref: 770    Recommendations Approved

The decision has been made to appoint Centre for Sustainable Energy to deliver the Tenants’ Energy Advice Service. The Service is in place to target tenants who are in, or at risk of fuel poverty. The evaluation panel are satisfied that the appointed contractor is able to provide the service as set out in the Specification.

Decision:

Bristol City Council wishes to commission Citywide service to BCC council tenants - providing fuel poverty advice, switching provider, accessing funding as well as advice to reduce damp and condensation.
Following a competitive tendering process Bristol City Council is appointing the Centre of Sustainable Energy to deliver its Tenants’ Energy Advice Service. The contract will begin on a two year basis with the option to extend for a further two years.

That Cabinet Approves:

  1. The incorporation of £18.5m (£13.5m COVID 19 emergency response fund and £5m hardship fund) into the Council’s budget;
  2. The incorporation of £88.3m funding on account held temporarily in the Councils reserves for the provision of Business Support Grant Funding;
  3. The delegation of authority to the Head of Paid Service and the Director of Finance in consultation with the Mayor and the Deputy Mayor, Cabinet Member for Finance, Governance and Performance, to make any urgent decision relating to the emergency response which involves new policy or a change to existing policy and to make any necessary technical adjustments or adjustments to the budgets upon receipt of the above and future Government funding in response to the COVID 19 pandemic; with transfers to and or from reserves as appropriate.

That Cabinet Notes:

  1. Decisions taken under emergency / urgent payments:
    1. The protocol for the disbursement of the Hardship fund and indicative funding streams as set out in Appendix A1;
    2. The section 13a policy for additional Council Tax relief as set out in Appendix A2

    4. The emergency procurement protocol as set out in Appendix A3;
    5. Additional payments of £1.359m to be made to care providers as set out in Appendix A4.

2.      The 2020/21 budget is being reviewed and a redirection of existing budget and earmarked may be required during the year;

3.      The indicative allocations from initial grant funding (detailed in Table 2) and that the Director of Finance in consultation with the Head of Paid and Cabinet Member for Finance will amend these allocations within the overall funding limit to respond to need as required.

Authorises the Executive Director Growth and Regeneration, in consultation with the Deputy Mayor for Finance Governance & Performance to proceed with the Making of a Compulsory Purchase Order under S226(1) (a) of the Town and Country Planning Act 1990 as set out in the Cabinet decision of 6 November 2018 for any or all of the interests in the land included within the red line on the attached plan entitled "Draft Compulsory Purchase Order Plan", and numbered PROP-ARC-0067c, for the regeneration, development or improvement of that land;
  2. Authorises the Executive Director Growth and Regeneration, in consultation with the Deputy Mayor for Finance Governance and Performance to take all necessary steps to prepare, and to make (a) an application to the Secretary of State for a Stopping Up Order pursuant to S247 of the Town and Country Planning Act 1990, and (b) an application to the Magistrates Court under s116 of the Highways Act 1980 to stop up or divert the highway for those areas of highway required to be stopped up within the area shown on plan PROP-ARC-0067c attached to the report to enable development to proceed, and to make the case for the proposed order at a public inquiry, if one is called;
  3. Authorises the Executive Director Growth and Regeneration, in consultation with the Deputy Mayor for Finance Governance & Performance to appropriate to the Council's planning purposes any or all of the land included within the red line on the attached plan entitled "Draft Compulsory Purchase Order Plan", and numbered PROP-ARC-0067c, that is held by the Council to enable the regeneration, development or improvement of that land.

  1. Authorise the Executive Director Growth and Regeneration, in consultation with the Cabinet Member for Transport and Energy, (within the budgets identified above) to take all steps necessary, within the council’s scheme of delegations, to procure and appoint contractors to carry out all works identified in Appendix A, making use of the existing term contract and/or approved frameworks, where appropriate ,and including individual decisions where the value exceeds the key decision threshold;
  2. Authorise the Executive Director Growth and Regeneration, in consultation with the Cabinet Member for Transport and Energy, to make reasonable changes to the programme of works to ensure delivery of the programme, in accordance with the Council’s scheme of financial delegations.

That Cabinet:

  1. Notes the Direction dated  13 March 2020  and accompanying letter from Rt. Hon Rebecca Pow MP (Appendix A) which includes a requirement for Council to implement a Medium Clean Air Zone Class C, as set out in the OBC and previous Cabinet report;
  2. Approves receipt of and authorise spend of £12m funding from the Joint Air Quality Unit for delivery of the of the Medium Clean Air Zone Class C, as Directed by Government;
  3. Approves receipt of  £1.25m additional funding and authorise spend of the Grant on further scheme development through to delivery of the Full Business Case;
  4. Notes the revised timeline within the Direction  for delivery of a Full Business Case submission before 18 September, 2020;
  5. Authorises the Executive Director for Resources, in consultation with the Mayor, to proceed with and make operational decisions regarding the planning and development of the Full Business case for the CAZ, including working with Government to rethink the timeline for the proposed ‘go-live’ date that is currently set for April 2021 in order to support and protect businesses in Bristol;
  6. Notes that the circumstances regarding COVID-19 currently remain unquantifiable in terms of risk to this project due to the changing and unpredictable environment that our country is facing and accept that this will inevitably affect the overall timeline for implementation of the CAZ.
